The content, such as information, texts, graphics, and images, on this website is protected by copyright. Therefore, any copying or reprinting of any image displayed on this website without prior written authorization from AG SAS is prohibited.

Each purchase of Products (as defined below) sold on this website is governed by the following terms:

General Terms and Conditions

Article 1 - Definitions

1.1. The term "Site" refers to the website www.agmoto.com, dedicated to the sale of products by AG sas di Accossato Giovanni.
1.2. The term "Customer" refers to the individual who is 18 years of age or older, or a legal entity making a purchase on the Site, in accordance with these general terms of sale.
1.3. The term "Order" refers to the product request form (as defined below) completed by the Customer on the Site.
1.4. The term "Products" refers to the goods sold on the Site, according to the following general terms of sale.
1.5. The term "Customized Products" refers to goods that are customized at the request of the Customer.
1.6. The term "Price" refers to the amount that the Customer must pay for the Products purchased on the Site.
1.7. The term "Contract" refers to the distance sale contract for the sale of Products, according to the following general terms of sale.
1.8. The term "Parties" refers to AG SAS and the Customer.
1.9. "Consumer" is the Customer as a natural person aged 18 years or older acting for purposes unrelated to their commercial, industrial, artisanal, or professional activity.

Article 2 - Contract Formation Process

2.1. The Products are sold in accordance with the terms and conditions set out in the contract published on the Site at the time of the order. Each Contract is deemed concluded at the price in effect when the Customer submits the Order on the Site.
2.2. To complete a purchase on the Site, the Customer must follow these simple steps:
• I) select the Product, select the product specifications (where required), and click the "ADD TO CART" button: a summary of the main features of the selected Product and the total Price due, including shipping costs (excluding any applicable customs duties) and taxes, will appear.
• II) click the "GO TO CHECKOUT" button and log into their account or, if not previously registered, register on the Site. Alternatively, the Customer can continue the order process as a guest without prior registration.
• III) complete the order request form ("Order"), indicating the delivery address and choosing the preferred shipping method (where applicable) and payment method; the Customer must verify the accuracy of the entered data before proceeding to the next step. The Customer is responsible for the truthfulness of the entered data.
• IV) read and accept these General Terms and Conditions and the Privacy Policy by clicking the relevant hyperlinks and checking the box next to the statement "I have read and accept the Terms & Conditions and Privacy Policy."
• V) click the "CONFIRM AND PAY" button: this button will highlight, as required by law, that submitting the order implies the obligation to pay for the ordered Products.
2.3. After completing the purchase, the Customer will receive an order confirmation email, including these General Terms and Conditions, detailing: the essential characteristics of the purchased Products, the Price of each Product, shipping costs, and any other charges payable by the Customer, the payment method used, and the right of withdrawal (refer to Article 8), which can be exercised under the conditions provided by law.
2.4. The Contract is deemed concluded and binding for both Parties when AG SAS sends the order confirmation to the Customer’s provided email address.
2.5. The Contract is archived, and the Customer can view it by accessing their personal area or contacting the Customer Care service via the contact form on the site.
2.6. The creation and supply of Customized Products proposed for sale on the Site are subject to a specific request from the Customer, to be made following the instructions on the Site. Payment in advance is required for the purchase of such Products, and the right of withdrawal from the purchase contract is excluded for the Customer.

Article 3 - Delivery Times and Methods

3.1. AG SAS will organize the delivery via courier for all Products ordered to the address specified in the Customer's Order.
3.2. Product shipping will occur within 24-48 hours for Italy, within 48-72 hours for other European countries, and within 3 working days for non-EU countries.
3.3. The Consumer Customer is not required to grant AG SAS the additional period referred to in Article 3.2 if:
a) AG SAS has expressly refused to deliver the Products; or
b) if the agreed delivery date must be considered essential, considering all the circumstances surrounding the conclusion of the Contract; or
c) if the Customer-Consumer has informed AG SAS before the conclusion of the Contract that delivery within a specific date is essential.
In these cases, if the Customer-Consumer does not receive the Products within the agreed time frame, the Customer-Consumer is entitled to immediately terminate the Contract, without prejudice to the right to damages, and AG SAS must refund the Customer-Consumer without undue delay all sums paid under the Contract.
3.4. If one or more Products listed in the Customer's Order are no longer available when AG SAS receives the Order from the Customer, through no fault of AG SAS, AG SAS will promptly inform the Customer via email. In such cases, the Order will be either fully canceled or accepted for only the available Products. In case of cancellation, if the Customer has already paid for the Product(s), AG SAS will refund the full amount paid by the Customer without undue delay, and the related Contract will be considered terminated. In case of partial acceptance, the Customer is required to pay (and will be charged) only for the available Product(s).
3.5. Upon delivery, the Customer or a trusted person must be present to ensure the packaging is intact and the received Products match the order. If there are visible defects, such as incorrect quantities and/or products or damaged packaging, the Seller asks the Customer, or their trusted representative, to report the anomalies on the delivery note and accept the goods with "Reserving the right to check" and contact the Seller within 7 days of receiving the order. If the report is not made within the indicated time, the Seller reserves the right not to accept the report.

Article 4 - Registration

4.1. To purchase Products, registration on the Site is not mandatory. The Customer may choose to register on the Site, which is free and does not involve any purchase obligation. Upon placing the first order, the Customer may register an account and receive an access password. The Customer must provide complete, correct, and truthful personal data, including the personal address and any other useful information for processing the order.
4.2. The Customer is required to keep a copy of the order confirmation received via email to the email address provided during registration on the Site.

Article 5 - Price and Payment

5.1. Prices are expressed in Euros (€) – conversion into other currencies is indicative and based on the exchange rate at the time of purchase. Prices include VAT (Value Added Tax) applicable at the time of the Order.
5.2. The total price at the end of the purchase process includes shipping costs, but does not include any customs duties or additional sales charges required for importing Products into a foreign country. Any additional costs related to customs clearance procedures are the sole responsibility of the recipient of the shipment.
5.3. The invoice must be requested at the time of the Order. To do so, the Customer, once the Order is complete, must contact our customer service via the contact form and provide the following information:
• Order number
• Name, surname, and/or company name
• Billing address
• Tax code and/or VAT number
5.3.1 Please note that, in the case of invoicing for commercial purposes, the warranty is limited by law to 12 months.

Article 6 - Force Majeure

6.1. In case of impossibility to execute the Contract, in whole or in part, due to a force majeure event, AG SAS will notify the Customer by email within 30 days from the date the Order was placed and will not be liable to the Customer, except for the refund of any sums already paid by the Customer.


ART. 7 - COPYRIGHT AND TRADEMARKS
7.1. The Contract does not grant the Customer any rights over trademarks, logos, and other distinguishing marks of any kind used or displayed on the pages of the Website, nor on the related contents.

ART. 8 - RIGHT OF WITHDRAWAL
8.1. Pursuant to Articles 52 and following of Legislative Decree No. 206 of September 6, 2005, and subsequent amendments (“Consumer Code” – not applicable to point 5.3.1), the Customer-Consumer has the right to withdraw from the Contract, without any liability and without providing any reason, within 14 days from the delivery of the Products (or, in the case of a Contract relating to multiple Products ordered by the Customer-Consumer in a single order and delivered separately, the withdrawal period starts from the day the Customer-Consumer or a third party designated by them, other than the carrier, takes physical possession of the last item).
8.2. To exercise the right of withdrawal, the Customer-Consumer must inform AG SAS of their decision to withdraw by writing to the contact form within the period indicated in the previous point 8.1.
8.3. In the event of exercising the right of withdrawal, the Customer-Consumer is required to return the Products received to AG SAS, shipping them back to AG SAS within 14 days from the date of receipt of the order. The return procedure is indicated on the 'returns' page.
8.4. The direct costs of returning the Products will be borne by the Customer-Consumer, including any customs duties.
8.5. The Customer-Consumer must return the Products in good condition, without removing the original labels. Returned items must be carefully packed to protect the original packaging from any damage, writings, or labels. The Customer-Consumer is responsible for any decrease in the value of the goods resulting from handling them in a way other than what is necessary to establish the nature, characteristics, and functioning of the Products.
8.6. If the right of withdrawal is exercised in accordance with the above instructions, AG SAS will refund, within 14 days from receipt of the withdrawal notice, all payments received from the Customer-Consumer for the Contract to which the withdrawal relates. AG SAS will issue the refund via the same payment method used by the Customer-Consumer for the initial transaction (e.g., credit card). However, pursuant to Article 56, paragraph III, of the Consumer Code, AG SAS may withhold the refund until it has received the Products or until the Customer-Consumer has provided proof of having returned the Products, whichever occurs first.
8.7. The right of withdrawal can be exercised by the customer acting for purposes unrelated to their business, industrial, craft, or professional activity. Therefore, the right of withdrawal is excluded for purchases made by resellers and/or companies, as stated in point 5.3.1.
8.8. The right of withdrawal is also excluded, pursuant to Article 59 of the Consumer Code, in the case of the supply of Customized Products (see previous Article 2.6), as well as the supply of sealed Products that cannot be returned for hygienic reasons or for health protection reasons, and/or that have been opened after delivery.
8.9. No refunds are provided for Customized Products, and discounted products (seasonal sales or special promotions) are non-refundable.

ART. 9 - CUSTOMER RIGHTS IN CASE OF NON-CONFORMITY OF PRODUCTS
9.1. If the Customer is a Consumer and claims a defect in conformity of a Product, they have the right to have the conformity restored through repair or replacement (the Customer-Consumer can choose between repair and replacement of the Product under the conditions provided by law), or to receive a proportional reduction in price or the termination of the Contract in accordance with the terms and conditions established in Articles 128 et seq. of the Consumer Code. The Customer-Consumer does not have the right to terminate the Contract if the defect in conformity is of minor importance.
9.2. Following the Customer-Consumer's communication pursuant to the previous Article 9.1, AG SAS will proceed with the collection of the Product from the Customer-Consumer's address within a reasonable time and, after verifying the existence of the claimed non-conformity, will issue a partial or full refund of the Price. AG SAS may, however, propose alternative remedies, such as, for example, issuing a voucher of an amount equal to the sum paid by the Customer-Consumer, to be used later by contacting Customer Service; if the Customer-Consumer agrees, AG SAS will proceed to implement the proposed solution.
9.3. AG SAS is responsible to the Customer-Consumer for any defect in conformity existing at the time of delivery of the Product and that manifests itself within two years from that moment. The action to assert defects not fraudulently concealed by AG SAS is prescribed in any case within 26 months from the delivery of the Product.
9.4. The warranty does not cover damage caused by incorrect installation, normal wear, or misuse.

ART. 10 - PRIVACY
10.1. The data provided by the Customer and necessary for the execution of the Contract will be processed in accordance with the provisions of Regulation (EU) 2016/679 regarding the protection of individuals with regard to the processing of personal data and the free movement of such data, as well as Legislative Decree No. 196/2003 on personal data protection. For more information, the Customer can consult the Privacy section of the Website.

ART. 11 - COMMUNICATIONS
11.1. All communications between the Parties must be made in writing and sent to the other party’s address indicated in the Contract, for AG SAS, and in the Order, for the Customer.
11.2. All communications sent to the other party's email address, as indicated in Article 11.1, will be considered validly sent in writing.

ART. 12 - HOMOLOGATION
Except for the products defined in the description with the terms “homologated” and/or “street legal,” the products sold on www.agmoto.com are not homologated for use on public roads, and are intended solely for closed circuits or private places. Homologation is understood to be limited to countries belonging to the European Union.

ART. 13 – LIMITATIONS OF LIABILITY
13.1. The Seller is not liable for any delays in the delivery of an order.
13.2. The Seller disclaims any responsibility for damages of any kind, material or physical, including to third parties, resulting from improper or incorrect application, use, or installation of all items sold.
13.3. The colors of the Products shown on the Website are indicative and may depend on the resolution of the device used by the user. The Seller assumes no responsibility if the color of the Product differs from what the user expected.
13.4. The Seller commits to keeping the site and the information contained therein, such as descriptions, images, applications, and sales conditions, up to date; however, there may be errors, inaccuracies, or publication mistakes that may be updated at any time, for which the Seller cannot be held responsible.
13.5. The products sold on the website www.agmoto.com are aftermarket products and therefore may not correspond exactly to the original spare parts. The Seller cannot be held responsible for direct or indirect damages, accidents, injuries, deaths, or any other event occurring from the use of products sold on this site.

ART. 14 - APPLICABLE LAW AND JURISDICTION
14.1. The Parties, by entering into the Contract pursuant to the previous Article 2, agree that it will be governed and interpreted in accordance with Italian law. The Parties acknowledge that the application of the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded.
14.2. For any dispute concerning the validity, execution, or interpretation of the Contract or related matters, the competent court will be:
a) the Court of the place of residence or elected domicile of the Customer, if the Customer is a Consumer and is resident or domiciled in Italy.

SHIPPING INFORMATION

  1. Orders are processed within 48 business hours from payment confirmation. Delivery occurs within 3-7 business days, excluding any delays beyond our control. The stated times refer to business days, excluding weekends, and national holidays.
  2. Shipping costs are:
    Italy: €12.08 for orders under €199. For orders over €199, shipping is free.
  3. The Seller will arrange the delivery of the selected and ordered products through specialized carriers. Upon delivery, the presence of the Customer or a trusted person is required to ensure the packaging is intact and that the Products match the order. In case of visible defects, such as incorrect quantities and/or incorrect products and damaged packaging, the Seller asks the Customer or their trusted person to note the anomalies on the transport document and accept the goods with “Reservation of Control” and contact the Seller using the contact form within 7 days of receiving the order. If the notification is not made within the indicated time, the Seller reserves the right not to accept the claim.
  4. When the package is handed to the carrier, the Customer will receive a notification by email with a tracking number to monitor the shipping status.
  5. For purchases made by customers residing outside the European Union (EU), any customs duties, import fees, taxes, or other charges required by the laws of the destination country are the sole responsibility of the buyer. These costs are not included in the product price or shipping fees indicated during checkout. If customs duties or import fees are not paid by the buyer and the package is returned to the Seller, any return costs will be deducted from the refund. Shipping fees will not be refunded.
  6. In the case of storage due to customer unavailability or incorrect address communication, the customer will bear the storage costs, and after 72 hours, the returned package will incur additional shipping costs. If the customer requests a refund after not collecting the goods, the refund will be issued minus shipping, storage, and return costs.

Made a purchase on www.agmoto.com and not satisfied with the product or need to return it?
No problem: you can return all or part of the ordered products within 14 days from receipt.
Click on "Request Return" from your order list.
Select the reason "Withdrawal within 14 days" and an optional note, then confirm.
Wait for the confirmation email with the RMA form to place on the package. Inside the box, include a copy of your order.
Direct return costs are at your expense.
Once the goods are received and inspected by our warehouse, a refund will be issued to the payment method used for the initial purchase.
What is the RMA form?
RMA = Return Merchandise Authorization.
Attach the form received by email to the outside of the box and ensure the code is clearly visible. The warehouse will reject any package without the correct form.
Exclusions and precautions:
The merchandise must be returned intact, unused, and with its original packaging. Customized products, such as brake and clutch lines, and products that cannot be returned for hygienic reasons, are not eligible for return.
